By participating in the Everjump 1000 Jump Challenge competition (hereinafter referred to as “ competition ”), you acknowledge and accept the following terms and conditions and data protection information:

2. Terms and conditions of participation:
To participate in this competition, participants must take a before-and-after photo of their body in the style of the example below* after completing the 1000 Jump Challenge in the EVERJUMP app and grant Pala Health GmbH (brand: EVERJUMP) permission to use it for promotional purposes. Participants must send the photo to the following email address no later than February 28, 2023: support@everjump.fit. The email must also include the participant's full legal name and correct email address.
*
Natural persons from Germany and France are eligible to participate, provided they have correctly submitted their before-and-after photo within the participation period (January 1, 2023, 00:01 to February 28, 2023, 23:59, the latter being the “entry deadline”) and are at least 18 years old at the time of participation.
Employees of the organizers and participating cooperation partners, as well as their relatives, are excluded from participation.
In the event of a culpable breach of the terms and conditions of participation, the organizers are entitled to exclude the participant with immediate effect.
3. Profit and profit determination:
Among all participants who meet the above conditions of participation, the following prize will be raffled off a total of three times:
- A voucher worth €250.00. This voucher entitles the holder to purchases on the Everjump website and/or can be redeemed for Everjump products, provided the recipient is at least 18 years old. The voucher for €250.00 is transferable.
After the closing date for entries, the organizers will select one winner from all participants.
The winner will be contacted by email no later than March 12, 2023, at 11:59 p.m. The winner must respond to this email within ten (10) business days. If the winner does not confirm receipt of the notification within ten (10) business days, the prize will be forfeited and another participant may be selected.
Cash payment, changes and/or exchanges of the prize are excluded.
All operating, incidental and consequential costs arising from the prize or its receipt or use shall be borne by the participant himself, unless these are expressly covered by the respective organizer.
4. Cancellation and changes to the competition:
The organizer reserves the right to cancel the competition immediately and without prior notice for important reasons. The competition may also be cancelled due to force majeure or other legal reasons.
5. Other:
Should individual clauses of these terms and conditions be or become invalid, the validity of the remaining terms and conditions shall remain unaffected. The invalid clause shall be replaced by a provision that is appropriate in the specific case and most closely reflects the intended purpose of the invalid clause.
6. Data security and privacy:
By participating in the competition, the participant expressly agrees to these terms and conditions. Furthermore, the participant consents to the use of the data collected in connection with the competition (in particular, but not limited to: name, email address) for the purpose of conducting the competition. The participant also consents to the organizers contacting the winner via their email address.
The organizers may transmit the winner's data to all relevant cooperation partners in order to facilitate the execution of the competition and the distribution of the prizes.
Participants can withdraw their consent at any time by clicking the unsubscribe link at the bottom of each message. Data will not be shared with unauthorized third parties.
7. Agreement on usage rights for photos concerning Pala Health GmbH
The participant confirms that they are of legal age at the time of the above-mentioned recordings (portraits) or have presented a declaration of consent from their parents, which is attached as an appendix to this contract.
The participant confirms and agrees that the photographs (images) taken may be reproduced, exhibited, and publicly displayed by Pala Health GmbH (brand: EVERJUMP) in unaltered or modified form, without any restrictions regarding spatial, temporal, or content-related use and for all conceivable purposes. This includes, in particular, use for commercial purposes.
The participant grants the organizer the exclusive right to use the photographs taken. This includes editing, retouching, and the use of the images for montages. Private, non-commercial use of the photographs by the model is excluded. Private use expressly includes use on a private website.
The participant confirms that by participating in the competition, this release covers all claims that may arise from the creation, reproduction, distribution, exhibition, or public display of the images against the model or third parties acting with the model's consent. I understand that this agreement does not establish an employment relationship. This agreement and release are governed exclusively by German law, regardless of the location of the shoot. It is irrevocable.
Legal recourse is excluded.
